Alterity has adopted and published its Arbitration Rules which can be found here. Because arbitration is a creature of contract, an agreement which can be pre-existing or adopted after a dispute has arisen, the parties to an arbitration clause are the masters of the process, including scope of the dispute to be resolved, the venue and choice of law for the process, and other aspects of the process. Indeed, the parties can modify their existing arbitration agreement to adopt the Alterity Rules if they choose to do so.
The Rules are subject to ongoing review and modification to meet the needs of the parties. These Rules are designed to be easy to understand, flexible, transparent, and efficient in achieving a prompt resolution with whatever degree of formality the parties desire. The Rules allow for virtual or in-person hearings, or a blend of the two, for a single or multiple arbitrators, for time limits on the process, for formal evidentiary hearings or summary adjudication on the written submissions, for Baseball or High-Low procedures, and many other variations. Many of these features are further described here. Fees are clearly described. Potential conflicts of interest are required to be disclosed. Alterity arbitrators are very experienced in a wide variety of specialized fields and are supported by ongoing training and preparation.
